1. PLATFORM NATURE AND DEFINITION

1.1 Platform Characterization

Brokersify is a digital networking platform that exclusively facilitates connections between potential property searchers and RERA Registered real estate professionals. The platform does not engage in, conduct, or perform any brokerage activities related to property transactions.

1.2 Platform Function

• Provide a digital networking infrastructure connecting property searchers with real estate agents.
• Offer a subscription-based service model for accessing professional real estate networking services.
• Enable communication and potential collaboration between property seekers and licensed real estate professionals.

1.3 Key Operational Principles

• Strictly intermediary role between property seekers and real estate agents.
• No involvement in direct property transactions.
• No commission or brokerage fees collected from property buy/sell/rent activities.

1.4 Platform Responsibility

Brokersify's liability is strictly limited to:

• Providing a functional networking platform.
• Maintaining user communication channels.
• Ensuring basic platform performance and reliability.

2. RERA Compliance and Platform Usage

• Brokersify permits only Real Estate Regulatory Authority (RERA) registered brokers to list on the Home Page, in compliance with the Real Estate (Regulation and Development) Act, 2016 and its amendments. Please refer RERA offical Policy for more Information.
• Users enabling non-RERA registered brokers on the Home Page are solely responsible for their actions and any legal consequences.

3. User Responsibilities

• You must be at least 18 years old to use this service.
• You agree not to use the service for any illegal activities. please refer "Prohibition of Illegal Activities" policies for this.
• Prohibition of Illegal Activities:
  • Users are strictly prohibited from utilizing the Platform for any unlawful purposes or in furtherance of illegal activities.
  • Any user found engaging in, facilitating, or promoting illegal activities through the Platform shall bear sole and full responsibility for all legal consequences arising therefrom.
  • The Platform reserves the right to report any suspected illegal activities to appropriate law enforcement authorities without prior notice to the user.
  • Engagement in illegal activities constitutes grounds for immediate termination of the user's account and access to the Platform.
• Users are responsible for maintaining the security of their account and may not share credentials.
• Users are responsible for all content they upload, share, or transmit through the service.
• Users must provide accurate and up-to-date information regarding their RERA registration.

4. Platform Policies

• We reserve the right to verify the RERA registration status of any user at any time.
• All content posted must respect intellectual property rights.
• We reserve the right to terminate accounts that violate our terms.
• Brokersify may modify these terms at any time. Continued use after changes constitutes acceptance.

6. Pricing Policy

• Current Alpha Status:
  • As of October 14, 2024, Brokersify (the "Platform") is operating in Alpha mode.
  • During this Alpha phase, the Platform is available for public use and testing at no cost to users.
  • This free-of-charge status is temporary and subject to change without notice.
• Future Subscription Model:
  • The Platform reserves the right to implement a subscription-based model upon exiting the Alpha phase.
  • Users agree that continued use may require compliance with a paid subscription model once the Platform enters full production mode.
• Transition to Production Mode:
  • The Platform will provide registered users with a minimum of fifteen (15) days' notice prior to the activation of full production mode and any associated pricing changes.
  • This notice will be communicated through the contact information provided by the user during registration.
• User Options and Obligations:
  • Upon implementation of the subscription model, users may choose to subscribe to the Platform's services or discontinue use.
  • Users from the Alpha phase are not automatically obligated to subscribe to paid services.
  • Continued use after the transition to the paid model will constitute acceptance of the then-current pricing terms.
• Voluntary Nature of Subscription:
  • The Platform does not compel any user to subscribe to paid services.
  • The decision to subscribe or discontinue use upon implementation of paid services rests solely with the user.
• Current Pricing Confirmation:
  • As of October 14, 2024, no fees or subscriptions are being charged to any users.
  • This no-fee status is explicitly tied to the Platform's Alpha mode of operation.
• Modifications to Pricing Policy:
  • The Platform reserves the right to modify this Pricing Policy at any time.
  • Any modifications will be communicated to users and posted on the Platform with reasonable notice before taking effect.

By continuing to use Brokersify, users acknowledge that they have read, understood, and agree to be bound by this Pricing Policy.

7. Privacy Policy

We respect the privacy of users at utmost priority.

• Data Collection:
  • We collect personal information provided during registration, including but not limited to name, email mobile number, and RERA registration Self Declared status but not details of RERA License.
• Data Security:
  • We implement industry-standard security measures to protect your personal information from unauthorized access, disclosure, or alteration.
  • However, no method of transmission over the Internet is 100% secure, and we cannot guarantee absolute security.
• Third-Party Sharing:
  • We do not sell your personal information to third parties.
  • Information may be shared with service providers who assist in operating our Platform, subject to confidentiality agreements.
• User Rights:
  • Users have the right to access, correct, or delete their personal information stored on our Platform.
  • You may opt-out of non-essential communications at any time.
• Data Retention:
  • We retain personal information only for as long as necessary to provide our services and comply with legal obligations.
  • User account information is retained until the account is deleted or becomes inactive for an extended period.
• Changes to Privacy Policy:
  • We reserve the right to update our Privacy Policy periodically.
  • Users will be notified of significant changes via email or through a notice on our Platform.

8. LIMITATIONS OF LIABILITY

8.1 Exclusion of Transactional Liability

Brokersify expressly disclaims liability for:

• Any property transaction details.
• Financial negotiations between users and real estate agents.
• Outcomes of connections made through the platform.
• Accuracy of information shared by real estate professionals.

9. MODIFICATIONS TO TERMS

Brokersify reserves the right to modify these terms and policies, with updates communicated to users through the platform.
